Overview

Charles is a seasoned trial attorney with experience in all manner of civil and complex commercial disputes. He has represented clients ranging from individuals and small businesses to Fortune 500 companies, and has first-chair experience prosecuting and defending actions in state and federal court. Charles has litigated cases involving real estate disputes, breach of contract, breach of fiduciary duty, lender liability, partnership disputes, CERCLA environmental liability, and a wide range of other business matters. Charles’s practice also includes significant appellate practice and advise for business clients on risks and strategy. The following examples highlight Charles’s extensive litigation experience:

 

  • Obtained complete dismissal, with prejudice, of all tort claims against Fortune 500 client in case where the plaintiff alleged damages in excess of $1 billion, with award of attorneys’ fees for client.

 

  • Obtained $5 million judgment for landlord against tenant for damage to commercial premises, abandonment, and failure to pay rent on a long-term lease.

 

  • Second chair in multi-week trial, obtaining defense victory where plaintiff had brought spurious lien and other statutory and tort claims, seeking over $100 million in damages against client.

 

  • Obtained multimillion-dollar judgments on behalf of landlords, developers, owners, and contractors, including in cases that went to trial involving civil theft and breach of Colorado’s mechanic’s lien trust fund statute.

 

  • Successfully handled complex business divorces for dentists and other professionals.

 

  • Quieted title, or obtained easement access, benefiting real estate development projects on behalf of developers and statutory or quasi-governmental entities in Colorado.

 

  • Prevailed in lawsuits against HOAs and insurance companies.

 

  • Prevailed before Colorado Court of Appeals on multiple complex commercial disputes, both where client won at trial and where client lost at trial but prevailed on appeal.

 

  • Successfully settled hundreds of cases at mediation for clients in a range of commercial disputes, many involving real property or commercial transactions.
